Public Records Request

All public records subject to and not exempt from disclosure pursuant to Florida Statutes shall be available for inspection or copying during normal office hours at the District Office or other School Board offices in which records are maintained under procedures adopted by the Superintendent in accordance with applicable law.
Public records are processed in the order in which they are received. All requests are processed in a reasonable time according to statute. Some requests may require more time than others depending on the scope, size, redactions needed and number of departments involved in completion of the request.
Exempt Records
Various types of records are considered exempt and/or confidential and therefore, not available through a public records request. Specific statutory exemptions are contained throughout Florida Statutes. To view these exemptions, please visit Statutes & Constitution :View Statutes : Online Sunshine.
Records maintained by the District which are exempt from public inspection include but not limited to security camera videotape pursuant to Florida Statutes 119.071(3)(a) and 281.301.
Such videotape is also confidential and exempt as an education record when it depicts students, pursuant to Florida Statute 1002.221.
Under Florida Statute § 119.071(3) and related security laws, security system plans, critical infrastructure data, and surveillance video recordings are kept confidential to protect school safety
Service Charge
HCSD may impose a reasonable service charge for the actual cost of extensive labor and technology required. We must review every email/document for any personally identifiable information that is exempt from public records law. If there is exempt information, it will be redacted (removed).
HCSD charges for requests that consume more than 15 minutes of time to complete. This is at the rate of the lowest-paid employee capable of completing the job.
When multiple requests are made by one individual, they will be considered as one request, and extensive use charges will be applied after the first fifteen (15) minutes.
Payment is required before the request will be processed.
Narrowing and making your public records request as specific as possible may reduce the extensive labor costs. Narrowing down requests to keywords or phrases instead of open-ended terms such as “any and all records.” Also, narrowing a request to certain individuals or a particular time frame or date range can greatly reduce the use of extensive labor.
Charges for copies of public records not exceeding 8 ½ X 14 in size shall be 15¢ for each one sided copy or 20¢ for each two sided copy, unless a different fee is otherwise prescribed or permitted by Florida Statutes.
A one dollar ($1.00) fee shall be assessed for a certified copy of a public record. The Hernando County School District may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable and shall be based on the cost incurred for such extensive use of information technology resources or the labor cost of the personnel providing the service that is actually incurred by the agency or attributable to the agency for the clerical and supervisory assistance required, or both.
An exemption contained in this chapter or in any other general or special law shall not limit the access of the Auditor General, the Office of Program Policy Analysis and Government Accountability, or any state, county, municipal, university, board of community college, school district, or special district internal auditor to public records when such person states in writing that such records are needed for a properly authorized audit, examination, or investigation. Such person shall maintain the exempt or confidential status of that public record and shall be subject to the same penalties as the custodian of that record for public disclosure to such record.
